These Terms of Service (“Terms”) govern your access to and use of Digital AI CRM, including any related websites, software, mobile applications, and services (collectively, the “Service”), provided by Blue Cipher AI LLC. By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Service. By using the Service, you represent and warrant that you meet this requirement.
2. Account registration and security
If you create an account, you must provide accurate, complete, and current information. You are responsible for maintaining the confidentiality of your credentials and for all activity occurring under your account. You must notify us promptly of any unauthorized use or suspected security incident involving your account.
3. License to use the Service
Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Service for your personal or internal business use, as applicable.
4. User content
You retain ownership of content you submit, upload, or otherwise make available through the Service (“User Content”). You grant Blue Cipher AI LLC a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to host, store, reproduce, modify, adapt, publish, translate, distribute, and display User Content solely to operate, improve, secure, and promote the Service. You represent and warrant that you have all necessary rights to the content you submit and that it does not infringe the rights of any third party.
5. Acceptable use
Your use of the Service is governed by our Acceptable Use Policy and Anti-Spam Policy, which are incorporated into these Terms. You are responsible for ensuring that your messaging and outreach comply with all applicable laws.
6. Intellectual property
The Service and all related software, content, and materials are owned by Blue Cipher AI LLC and are protected by intellectual property laws. Except for the limited license granted to you, no rights are transferred to you.
7. Engagements & billing
Service plans are billed monthly unless otherwise agreed in writing. Fees are non-refundable except as required by law or expressly stated in your plan. Specific deliverables and timelines are defined in your individual engagement agreement.
8. Disclaimers
The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee any specific business result.
9. Limitation of liability
To the fullest extent permitted by law, Blue Cipher AI LLC is not liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability is limited to the amount you paid us in the 12 months prior to the claim.
10. Termination
We may suspend or terminate your access to the Service at any time if you violate these Terms or applicable law. You may stop using the Service at any time. Provisions that by their nature should survive termination will survive.
11. Changes to these Terms
We may update these Terms from time to time. Material changes will be posted on this page with an updated effective date. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
12. SMS / text messaging program
This section governs the text messaging program operated by Blue Cipher AI LLC for Digital AI CRM. By providing your mobile phone number and opting in, you agree to these SMS terms. When you opt in, we may send you SMS/MMS messages related to your inquiry and account, including appointment scheduling and reminders, responses to your requests, customer care, account and service notifications, and — where you have consented — promotional and marketing messages.
13. SMS consent, frequency, and rates
You provide consent by submitting your mobile number through a form on our website, by texting us a keyword from your mobile device, by giving verbal consent, or by another method we disclose at the point of collection. Consent to receive marketing text messages is not a condition of purchasing any goods or services. Message frequency varies based on your interactions with us. Message and data rates may apply; these charges are billed by your mobile carrier, and Blue Cipher AI LLC is not responsible for them. Carriers are not liable for delayed or undelivered messages.
14. SMS opt out (STOP), help (HELP), and privacy
You can cancel the SMS service at any time by texting “STOP” to the number from which you received messages; we will send a one-time confirmation and you will no longer receive messages. For assistance, text “HELP” or email mail@bluecipherai.com. No mobile information, SMS opt-in data, or consent will be shared with or sold to any third parties or affiliates for their marketing or promotional purposes.
